| dc.description.abstract | إن دراسة موضوع دعاوى القضاء الكامل المتعلق بالمنازعات الإدارية، يعتبر من المواضيع المهمة خاصة من الناحية العملية، نظرا لانتشارها الكبير والواسع نتيجة الانفتاح الاقتصادي الذي عرفته الجزائر هذا من جهة، وتعدد القوانين المختلفة وتعديلاتها من حين إلى آخر وتعقيداتها خاصة في مجال تطبيقاتها، جملة من الدعاوى التي من أبرز تطبيقاتها الدعاوى الضريبية ودعاوى الصفقات العمومية ودعوى المسؤولية الإدارية، مما يطرح الكثير من النزاعات الناجمة عن تعقد الإجراءات وتنوعها تبعا لتعدد هذه الدعاوى، والتي يجب تجديد الأحكام العامة لها في ظل القضاء الكامل المتمثل في مجلس الدولة والمحاكم الإدارية وذلك من خلال تحليل النصوص القانونية التي منحها الاختصاص بنظرها لمعرفة مدى اتفاقها مع المبادئ والقواعد وغيرها في النصوص القانونية المشابهة في التشريعات الأخرى كمثال L'étude du thème des procédures de la pleine juridiction dans les litiges administratifs est l'un des sujets importants, en particulier dans la pratique, est due de sa large diffusion en raison de l'ouverture économique que l'Algérie a connue, ainsi que la diversité des différentes lois et leurs modifications de temps à autre et leurs complexités sont particulièrement pertinentes dans leur application. Parmi ses importantes applications : les réclamations fiscales, les poursuites pour transactions publiques et les poursuites en responsabilité administrative. Cela soulève de nombreux différends découlant de la complexité et de la diversité des procédures, selon le nombre de ces affaires, qu'on doit renouveler leurs dispositions générales sous la pleine juridiction du Conseil de l'Etat et des tribunaux administratifs. Il s'agit, par exemple, d'une analyse des textes juridiques dont il a donné compétence pour voir dans quelle mesure ils sont compatibles avec les principes, les règles et d'autres textes juridiques similaires d'autres lois. The study of legal proceedings issues, in compensation for administrative litigation, is considered as one of the most important subject in its practical side because of its wide extension after the economic opening which Algeria has automatically faced on the one hand, and the diversity of legal texts and their amendment and even the complexity of their field's applications on the other hand. Among the most important applications are the legal fiscal proceedings, legal public market proceedings and the legal proceedings of administrative responsibility that entail a lot of litigations, owing to the complexity and the diversity of the procedures.
