Abstract
لم يواجه التطبيق العملي للفكر الديمقراطي تحديا أكبر من إشكالية ضمان حرية ونزاهة انتخابات المجالس المحلية، فمذ أن أدرك المشرع الجزائري بأن الانتخاب أساس لإسناد السلطة السياسية ثارت قضية البحث عن الضمانات الواجب توافرها حتى تأتي نتائجه معبرة حقيقة عن نبض الشارع السياسيوذلك بغية إصلاح ما قد تتمخض عنه هذه النتائج من أخطاء بهدف إيجاد مجالس محلية تمثل الشعب تمثيلا حقيقيا.
فاختيارا لشعب لأعضاء المجالس المحلية المنتخبة عن طريق التعبير الحر عن إرادتهم، يمثل إحدى المقومات الأساسية لما يجب أن تكون عليها الديمقراطية الحقيقية، لأجل هذا اعتبر الإخلال بالقواعد الانتخابية إخلالا بتطلعات الشعب وخياراته الإستراتيجية،لأن المساس بصحة وسلامة العملية الانتخابية تعتبر انتكاسة فعلية لمبادئ الديمقراطية، ولا يكون ذلك إلا من خلال تزايد أساليب الغش والفساد الانتخابي الذي تجب ملاحقته عبر نظام قانوني فعال لمنع الممارسات الإجرامية التي تؤثر على إرادة الناخبين ومن ثم مشروعية الانتخابات المحلية، التي يتطلع من خلالها الشعب إلى اختيارا لأعضاء لإدارة شؤون الأقاليم،لما يضمن لهم من مباشرة حقوقهم وفقا لما تقتضيه القيم والمبادئ التي ينشدونها
The practical implementation of the democratic thought did not meet a challenge that is larger than the problematic of guaranteeing freedom and fairness of the elections of the local councils, since the Algerian legislator understood that the elections are the basis of political power, the issue of looking for the necessary guaranties to be provided, so as ensure that the results will represent the real pulse of the main in the street in order to screen of the aim of those results and their eventual mistakes so as to find local councils that are representing the people in a real way.
The people have the right to choose the numbers of the elected local councils through free expression of their will. This fact represents one of the essential standards of what should be done in the framework of real democracy. In this purpose only any breach of law and rules in the election field, is a breach toward the ambition of the people and their strategic choice, the failure in the implementation of fair and free election is a setback of the principles of democracy. This purpose will not be done except through increasing methods of corruption and breach of trust in the election which should be pursued by justice in an efficient way so as to fight against criminal practices which affect the good will of electors. This will allow the legal practice in the local election which allows to the people to carry out their real choice of the members of the council that will leads the affair of people according to the objectives that guarantee to them their rights according to the values and principles that they are looking for
L'application pratique de la pensée démocratique n'a pas été confrontée à un défi plus grand que la question de la garantie de la liberté et de l'intégrité des élections municipales. Depuis que le législateur algérien a compris que les élections sont une base pour confier le pouvoir politique, la question de la recherche des garanties qui doivent être disponibles s'est posée pour que ses résultats expriment véritablement le pouls de la rue politique afin de réformer ce qu'elle pourrait produire. Cela résulte d'erreurs visant à créer des conseils locaux qui représentent vraiment le peuple.
Le choix par le peuple des membres des conseils locaux élus par la libre expression de sa volonté représente l'un des fondements fondamentaux de ce que devrait être la vraie démocratie, pour cette raison, enfreindre les règles électorales était considéré comme une violation des aspirations et des choix stratégiques du peuple, car porter atteinte à la santé et à l'intégrité du processus électoral est un véritable revers aux principes de la démocratie, et non Cela ne peut se faire que par l'augmentation de la fraude électorale et des méthodes de corruption qui doivent être poursuivies à travers un système juridique efficace pour empêcher les pratiques criminelles qui affectent la volonté des électeurs et donc la légitimité des élections locales, à travers lesquelles le peuple cherche à choisir des membres pour gérer les affaires des régions, afin de leur garantir l'exercice de leurs droits conformément à Lorsque les valeurs et principes qu'ils recherchent
