Abstract
لقد شهدت الجزائر عدة أزمات وأحداث استثنائية، من بينها تفشي وباء كورونا؛ هذا الأخير الذي اعتبر في بادئ الأمر مشكلة داخلية بحثة في الصين، لكن انتشاره الواسع الذي طال مختلف أقطار العالم، والتي من بينها الجزائر أبرز خطورة هذا الوباء، لذا كان لزاما اتخاذ العديد من التدابير والإجراءات الصارمة والاستثنائية التي تندرج ضمن مهام الضبط الإداري، والتي برزت كجملة من القرارات التنظيمية المخصصة الهدف من جهة، والتي فرضت العديد من القيود على الحقوق والحريات التي كفلها الدستور من جهة أخرى، ورغم هذا فلا يجوز إهدارها بصفة مطلقة وإلا ترتب عن ذلك تعسف وانتهاك، ما حتم إحاطة تصرفات سلطات الضبط الإداري بجملة من القيود التي تشكل ضمانات لحماية هذه الحقوق والحريات.
Algeria has witnessed several crises and exceptional events, inculuing the outbreak of the coronavirus pandemic. Initially considered a purely internal problem in China, its widespread impact across different countries, including Algeria, highlighted the seriousness of this pandemic. Consequently, various strict and exceptional measures were taken, falling within the purview of administrative regulation. These measures, manifested as a set of dedicated regulatory decisionsfor a specific goal on one hand, and imposed restrictions on the rights and freedoms guaranteed by the constitutionon the other hand. Despite this, these rights and freedoms should not be unconditionally squandered, as that could lead to arbitrariness and violation. This necessitated placing the actions of administrative regulatory authorities under a set of restrictions that serve as safeguards for the protection of these rights and freedoms.
L'Algérie a connu plusieurs crises et événements exceptionnels, don't l'apparition de l'épidémie de Corona. Cette dernière, qui était initialement considérée comme un problème interne à la Chine, mais sa propagation généralisée qui a touché différents pays du monde, don't l'Algérie, a mis en évidence la gravité de cette épidémie, il a donc fallu prendre de nombreuses mesures et procédures strictes et exceptionnelles qui tombent dans le cadre des tâches de contrôle administratif, qui sont apparues comme un ensemble de décisions réglementaires adaptées à l'objectif d'une part, qui ont imposé de nombreuses restrictions aux droits et libertés garantis par la Constitution, d'autre part, et qui, malgré cela, ne sont pas autorisées. de les gaspiller absolument, sinon il en résulterait un arbitraire et une violation, ce qui a rendu nécessaire d'entourer les actions des autorités administratives de contrôle d'un ensemble de restrictions qui constituent... Des garanties pour protéger ces droits et libertés.
