| dc.description.abstract | تهدف هذه الورقة البحثية إلى تسليط الضوء على الجانب العملي لعملية التبادل الالكتروني للعملات الرقمية التي تعتبر أحد أهم منتجات الهندسة المالية الرأسمالية، والتي وجب النظر في عقودها وأنظمتها وواقعها، ثم تقييمها من الناحية الشرعية الفقهية واقتراح البدائل الشرعية للعقود المحرمة وضرورة إعادة النظر في مدى شرعية هذه البدائل أيضا، بالإضافة إلى ضرورة التطرق لعقود التحوط في التداول الالكتروني وصوره وأحكامه الشرعية. سنحاول من خلال هذا البحث التعرف على مفهوم العملات الرقمية وآليات تداولها إلكترونيا والآثار المترتبة عن إصدارها، وتحديد الضوابط الشرعية اللازمة لصرفها وتداولها بما يتناسب وقواعد الشريعة. This research paper aims to shed light on the practical side of the electronic exchange process for digital currencies, which is one of the most important products of capitalist financial engineering, whose contracts, regulations and reality must be examined, then evaluated in terms of legal jurisprudence and propose legal alternatives to forbidden contracts and the need to return Consider the extent of legitimacy of these alternatives as well, in addition to the need to address hedging contracts in electronic trading and its legal images and provisions. We will try, through this research, to learn about the concept of digital currencies and the mechanisms of electronic circulation and the implications of their issuance, and define the legal controls necessary for their exchange and trading in a manner consistent with the rules of Islamic. | ar |
