dc.description.abstractلا جرم أن الاهتمام بتجديد النظر في الموروث الإسلامي الذي لم يترك شاردة ولا واردة إلا وتناولها، قد شهد تزايدا ملحوظا في العقود الأخيرة؛ ذلك أنّ إعادة قراءة التراث الإسلامي في إطار تداولي يكشف عن الأبعاد التداولية في الدراسات الشرعية عامة والأصولية على وجه الخصوص. وهذه الدراسة تستهدف توسيعا لأفق الإجابة الممكنة عن سؤال التجديد وتعميقا لها، فهي تسعى إلى إماطة اللثام عن تداولية الخطاب الشرعي كونه خطابا تتجسّد فيه معالم النظرية التداولية، ومدى تبنيه للبنى الحوارية العرضية والاعتراضية، ذلك أنّ الحوارية مبدأ أساسي في كل تواصل لساني منظِّم لطرق التخاطب في الخطاب الطبيعي، فهو يمثّل أبرز الأساليب الحكيمة والبليغة التي استعملها المشرّع في القرآن الكريم لتجلية الحقّ استنادا إلى أسلوب الإقناع العقلي، ولهذا يسعى البحث إلى مقاربة تداولية للنظرية الحوارية وما مدى تجلّيها في الخطاب الشرعي.من خلال توظيف أهم المفاتيح الإجرائية التداولية التي تخدم الموضوع كمفهوم الخطاب،أقسامه (من حيث المعاني المستفادة، من حيث الوضع)، فضلا عن شروط المخاطَب المكلّف في العملية التخاطبية، استنادا إلى ما توصل إليه الدكتور طه عبد الرحمان، من الجمع بين ما ذهبت إليه النظرية التداولية المعاصرة وبين ما يقرّه التراث. No doubt that being interested in renewing studies of the Islamic heritage which is occupied to focus on reading and interpeting, has reached a higher degree in the recent years. We may say that the revision of reading of Islamic arab patrimony from the viewpoint of pragmatics discloses the exent of the trends of rotating in studying arabs in general and fundamentalist in particular . The present study ains at widening the horizons of possible reponse of the question of renewing and deepeningit.Its purpose is to discover the rotation of the legal discourse as a kind of communication that is built on natural system and on the extent of its adoption of episodicand contradictory dialogue structures. As we know, dialog is an essential principle in all organized linguistic communication for the ways of discourse whether normal or not since it constitutes the main wise and rhetorical methods that are used by the legislator in The Holy Qoran in order to attain the truth by the legislator in the holy coran in order to attain the truth through reason, that is why –we research the different aspect of the rotative theory and the extent of its presence in the legal discourse with reference to what has been reached by doctor Taha Abd-EIRahman who amalgamated what has been stated by the rotation theory with what has been inheritedar
